At least 41 U.S. district courts and 39 states now have their own rules addressing the discovery of electronically stored information. That news comes from Electronic Discovery Law, the always-informative blog of the E-Discovery Analysis & Technology Group at K&L Gates.
The blog has compiled two comprehensive lists of these jurisdictions, together with links to the specific statutes, rules, forms and guidelines:
- Local Rules, Forms and Guidelines of United States District Courts Addressing E-Discovery Issues.
- Current Listing of States That Have Enacted E-Discovery Rules.
Even in federal districts that have no local rules on e-discovery, some individual judges have created their own forms or set out their own protocols for e-discovery, the blog reports.
The blog promises to keep these lists up-to-date as new rules come along, so stay tuned there for further developments.
