Catalyst Helps Client Avert Discovery Sanctions

The Challenge

Our client was a large Silicon Valley manufacturer who was in a heated dispute with an accounting group over reporting advice it had been given. Millions of dollars were at stake stemming from lost stock value and its resulting impact on our client's business.

The case had been sitting quietly for several years when things began to heat up. The court started setting discovery deadlines that would require prompt action if there was any chance to meet them. Failure to do so could result in dismissal of the case and a significant judgment against the manufacturer.

The Quick Solution

We received a call for help on Wednesday with preliminary estimates on the number of documents to be reviewed and the size of the distributed legal team. We met quickly to determine the goals of the review, necessary review fields and the amount and type of expected documents and data.

By 5 pm the next day, we loaded over 475,000 pages into Catalyst CR and turned the site over to the initial review team of 8 contract attorneys. They spent the weekend reviewing documents and were able to prepare a production for the deadline Monday morning. Meanwhile, our partners were busy gathering additional data from a number of corporate locations to add to the collection.

This was just a start. Over the next few weeks the repository size grew to more than 22 million pages and the review team is now accessing the documents from 14 different locations. This translated to a data load of about 1.8 million pages a week.

During that period Catalyst (then caseSHARE) helped the team produce approximately 4.5 million pages of documents spread over 19 productions. We also helped pare down the review load by running advanced searches and marking potentially responsive or non-responsive documents prior to review.

Ultimately, we helped make sure the client met its discovery deadlines and avoided sanctions. As a result, our client will get its day in court.
