One of the challenges faced in global litigation is the fact that many disputes involve documents that were originally drafted in a variety of languages. This can create many problems for litigators who are using electronic data discovery tools to uncover the facts of a case. Here are a few areas where language can become problematic:

Mixed Messages: Never underestimate how language issues can hamper the collection process. For example, when drafting a litigation hold memorandum, keep in mind that words that may appear strong and clear in English may not always translate with the same intensity. Multiple versions
of the memorandum should be created in multiple languages and tested with native speakers for correct nuances.
