International IP: Best Practices for E-Discovery CLE Luncheon

E-discovery in intellectual property litigation is often a challenge. But when your IP case goes global, you face a whole new set of hurdles, legal and practical. How do you mediate among conflicting data privacy laws? How do you reach data stored abroad? When do you need and how do you find local counsel? How do you search and review in multiple languages?

At this live luncheon CLE program, three leading experts in international IP cases will share their knowledge and insights. They will identify the key issues relating to e-discovery in cross-border IP matters and offer best practices for addressing those issues.

Topics to be discussed include:

  • International privacy and safe harbor rules.
  • Venue selection.
  • Cross-border security of IP and source code.

About the speakers:

Daniel Johnson Jr. is a partner in Morgan Lewis's Litigation Practice and a member of the Intellectual Property Steering Committee. He is a senior trial lawyer and has tried numerous cases in state and federal courts throughout the United States and before the International Trade Commission, the American Arbitration Association, and Judicial Arbitration and Mediation Services. His practice focuses on high-stakes complex litigation, including patent cases, trade secret cases, disputes over software structure and source code, license disputes, and unfair competition and false advertisement disputes.


James K. Lynch is a trial lawyer in Latham & Watkins' San Francisco office and Vice Chair of the firm's Global Litigation Department. He is a member of the Intellectual Property and Technology and Securities and Professional Liability practice groups. He has extensive trial experience in complex litigation matters in federal and state courts as well as arbitrations involving patent, trade secret, auditor liability, securities fraud, and corporate governance disputes. Mr. Lynch's trial experience includes the 2010 "Top Defense Verdict" in a high profile trade secret dispute, seven arbitrations resulting in complete victories against claims seeking more than $2 billion in total, and a federal court trial resulting in a complete victory on all claims.

Adam Sand is associate general counsel for Ancestry.com, the world's leading website for family history. In this position, he advises the product, marketing and content acquisitions teams. He was formerly general counsel of ZL Technologies, an archiving and e-discovery software vendor, and was corporate counsel for eBay, where he was responsible for advising several of eBay's business units (including PayPal and BillMeLater) on contracts, risk avoidance and litigation issues.


Moderating the panel will be Alexander H. Lubarsky, a lawyer and business development manager for Catalyst.
